This article analyzes the typical problems that arise during the investigation of crimes of officials of public administration and business entities in the field of public procurement of goods (works, services). There was determined the necessity of further development of methodological recommendations for the investigation of abuse of office in the field of public procurement.
Detection and investigation of crimes in the field of public procurement begins with analytical processing information, search, seizure and fixation of non material and material traces.
For this purpose were suggested recommendations provided in the form of a sequence of actions, which includes the following steps:
- Search for actual data, raw information in any form from open, open by request, and sometimes closed sources;
- Actual data capture and fixation, data transformation into the format necessary for analysis and evaluation. The most common approach is to convert data from paper or electronic to machine readable;
- Analysis and evaluation of actual data – identification of patterns and relationships in the data, search for answers to questions and confirmation of these answers by facts, obtaining the opinions of experts, preparation of tables, charts and graphs, presentations, analytical help or articles in order to make the data and conclusions understandable and accessible to the target.
Analysis of the problems which practically prevent the prompt, complete, comprehensive and objective investigation of crimes in the field of public procurement, allowed to make such a generalization:
- the lack of a clear mechanism of interaction between law enforcement and regulatory authorities in combating offenses, including the fight against corruption "manifestations" in the field of procurement;
- duplication of functions by law enforcement agencies in connection with the lack of consistency in their activities in the detection and investigation of crimes in the field of public procurement (criminal proceedings for the same facts may be discovered by SBU investigators and detectives of NABU or other bodies);
- insufficient number of highly qualified staff with practical experience in procurement.
