Abstract

The article examines museum affairs as an independent object of administrative and legal research. It is substantiated that museum affairs are not only a component of the state’s cultural policy, but also an independent sphere of public administration within which governmental, organizational, control, coordination, and service functions of the state and local self-government bodies are exercised. Its public-law nature is manifested in determining the strategic directions of museum activity development, shaping and implementing state policy in the field of cultural heritage protection, normative regulation of the procedure for the establishment, registration, financing, and functioning of museums, as well as ensuring the accounting, preservation, use, and promotion of museum objects and collections. At the same time, museum affairs encompass a significant array of administrative-legal relations connected with the distribution of competence among public administration entities, supervision over compliance with legislation in the field of museum activity, provision of public services, digitalization of accounting and information processes, as well as the implementation of mechanisms for protecting the museum fund under current security challenges.

It has been established that the administrative-legal approach to understanding museum affairs makes it possible to identify the peculiarities of the legal status of museums, the competence of public administration entities in the field of protection, accounting, preservation, use, and promotion of the museum fund, as well as to determine the place of administrative procedures in ensuring the proper functioning of the museum sphere.

Attention is focused on the fact that museum affairs combine public-administrative, cultural- protective, informational, and social aspects, and therefore require a comprehensive administrative- legal analysis. It has been established that current challenges related to military threats, the necessity of evacuation and preservation of museum valuables, the digitalization of museum activity, as well as the adaptation of national legislation to European standards, increase the importance of effective administrative-legal regulation in this sphere.

It is concluded that museum affairs as an object of administrative and legal research encompass the totality of social relations arising in the process of organization, functioning, and state administration of museum activity, and that their proper legal support is an important prerequisite for the preservation of cultural heritage and the realization of the public interest.
