THE CONSTITUTIONAL AND LEGAL FRAMEWORK OF UKRAINE: EVOLUTION IN THE CONTEXT OF THE RUSSIAN-UKRAINIAN WAR AND POST-WAR RECONSTRUCTION

Abstract

The Russian-Ukrainian war, which began in 2014 and entered its most acute phase after the full-scale invasion of Ukraine by the Russian Federation in 2022, has created unprecedented challenges for the democratic development of Ukraine and its state and legal (political) regime. It is no coincidence that this conflict is considered as part of the global confrontation between democratic regimes (Ukraine, which receives strong support from the democratic West) and autocratic ones (Russia, which seeks support among post-Soviet, Asian, Latin American and African autocracies). The war changed the balance between security and freedom, affected the institutional mechanisms of government functioning and activated the role of civil society, which took over some of the state functions. The study of the transformation of the state and legal regime of Ukraine in the war and post-war period is extremely relevant, as it allows us to identify the risks of authoritarian tendencies, outline the prospects for democratization, and develop scientifically sound approaches to the formation of a new architecture of power and legal mechanisms of control. The article analyzes the prerequisites and factors of the evolution of the political regime of Ukraine, the impact of the war on its key institutions, as well as potential scenarios for post-war transformation and strengthening of democratic processes.
