LEGAL GROUNDS FOR USING ARTIFICIAL INTELLIGENCE-BASED CONTROL SYSTEMS DURING QUALIFICATION EXAMINATIONS OF CREW MEMBERS IN UKRAINE

Abstract

The article is devoted to the study of the features of the functioning of control systems based on artificial intelligence during the qualification examinations of crew members in Ukraine using the example of Remote Proctoring.

It was established that the introduction of computer testing into the system of training, certification and advanced training of seafarers significantly improved its results, as well as strengthened the protection of assessment results, in particular by promptly determining the results and preventing unauthorized interference with the software.

The main disadvantages of taking computer-based testing in a face-to-face format have been identified, including the mandatory need to appear in person at testing points, long queues for testing registration due to the low throughput of testing points, and high dependence on the human factor. It has been established that the introduction of martial law throughout Ukraine has significantly complicated the confirmation of seafarers' qualifications, as the problem of testing registration and long queues has only intensified.

It is substantiated that Remote Proctoring is a modern technological solution that operates on the basis of artificial intelligence, for the selection of candidates and confirmation of the qualifications of crew members, and also simultaneously combines an appropriate computer testing system (this, in particular, may be Crew Evaluation System (CES) 6.0) and software, the purpose of which is to track the process of passing this test. An analysis of the principles of functioning of Remote Proctoring shows that its implementation in the national system of training, certification and advanced training of seafarers will allow not only to overcome existing problems, but also to improve the confirmation of seafarers' qualifications. An additional justification for the need to introduce Remote Proctoring is the need for objective assessment of results and confirmation of the acquired qualifications of a person in a remote format, which has become widespread recently. Amendments and additions to the current legislation are proposed in order to create a legislative basis for the application of Remote Proctoring.
