LEGAL CHALLENGES OF DIGITALIZATION: UKRAINIAN EXPERIENCE IN THE GLOBAL CONTEXT

The article is devoted to the analysis of the legal system of Ukraine, which, under the influence of modern technologies, requires certain transformations. Particular attention is paid to such trends as digital human rights, cryptocurrencies, the right to access the Internet, artificial intelligence, the use of large amounts of personal data, etc. The legal framework of Ukraine regulating the sphere of digital technologies, personal data processing, e-commerce and information protection is considered. The national legislation in the field of digitalization was analyzed, which allowed to identify both positive changes to the digital reality and existing gaps that require further improvement. The need to create a modern model of legal regulation that would meet new technological conditions, the needs of adapting the Ukrainian legal system to the realities of the digital society was emphasized. Technological changes occurring on a global scale have a significant impact on national legislation and are becoming the subject of active discussions in the global legal community. The important role of state initiatives, international cooperation and digital education in the implementation of innovative approaches to regulation is indicated. The foundations of legal regulation of digital technologies in Ukraine are studied in comparison with the experience of the EU, the USA, Canada and Japan. Typical precedents and approaches that demonstrate the effectiveness of digital development in other countries are highlighted. Special emphasis is placed on the legal aspects of the functioning of artificial intelligence and the protection of personal data in online social platforms. A comparative analysis of the concepts of personal data protection in domestic and international legislation is conducted. The practical value of the study lies in the possibility of applying its conclusions to further improve the Ukrainian legal system in the context of digital transformations, ensuring sustainable socio-economic development, and forming effective legal mechanisms for regulating the latest social processes.
