PROSPECTS FOR THE INTRODUCTION OF PRIVATE FORENSIC EXAMINATION IN UKRAINE

Abstract

This article examines the feasibility of implementing private forensic medical expertise in Ukraine, particularly in the context of current challenges facing the country. Forensic medical expertise is a crucial element of the criminal process that ensures objectivity and accuracy in investigations. In the context of war and increasing pressure on state expert institutions, there is an urgent need to engage private experts. The article analyzes the positive aspects of introducing private forensic expertise, including high-quality assessments, rapid response times, and the incorporation of new technologies and methodologies.

High-quality assessments are essential in forensic investigations, as they directly impact the outcomes of legal proceedings. Private forensic experts often possess specialized knowledge and skills that enable them to conduct thorough and precise examinations. Rapid response times are another significant advantage, allowing for timely investigations that can be critical in urgent cases. Furthermore, the incorporation of new technologies and methodologies enhances the capabilities of forensic examinations, leading to more reliable results.

The article also discusses potential challenges that may arise during implementation, such as the need for a comprehensive legal framework to govern private forensic expertise and ensure accountability. It outlines necessary steps to establish an effective institution of private forensic medical expertise in Ukraine, including legislative reforms, the creation of a registry for certified private experts, and mechanisms for quality control.

Furthermore, the article explores the prospects of enhancing the quality of justice, creating new jobs, and adapting to international standards through the introduction of private expertise. The findings suggest that a well-regulated system of private forensic medical expertise could significantly improve the efficiency and effectiveness of criminal investigations in Ukraine while addressing existing shortcomings in the public system. Ultimately, this transition could lead to a more robust justice system that better serves the needs of society.
