СПІВВІДНОШЕННЯ КРИМІНАЛЬНО-ПРОТИПРАВНОГО ДІЯННЯ, ПЕРЕДБАЧЕНОГО СТ. 271 КРИМІНАЛЬНОГО КОДЕКСУ УКРАЇНИ, ТА ОКРЕМИХ КРИМІНАЛЬНО-ПРОТИПРАВНИХ ДІЯНЬ ПРОТИ ЖИТТЯ ТА ЗДОРОВ’Я ОСОБИ

Abstract

The article is devoted to analysis is conducted on the relationship between the criminal offense described in Article 271 of the Criminal Code of Ukraine and specific criminal violations against the life and health of individuals. Naturally, there is a need to address the issue of the correlation between violations of labor protection legislation when harm is caused to the health or life of the victim, and criminal offenses against the life and health of individuals.

The basis for such correlation lies in the specific objective and subjective characteristics of the criminal offense stipulated in Article 271 of the Criminal Code of Ukraine, which, when considered collectively, characterize the act as an infringement on occupational safety rather than merely an attack on an individual's life or health. Consequently, the composition of the criminal offense related to violations of labor protection legislation encompasses a specific range of possible cases of causing death or bodily harm, distinguished from other criminal offenses against life and health due to its specific focus.

The authors analyze the legislative context and legal aspects of these articles, identifying commonalities and differences between them. An essential part of the study concerns situations where violations in the field of labor protection may exacerbate the commission of criminal offenses. The article thoroughly examines the procedures for qualifying such violations and offers practical recommendations aimed at improving legislation and ensuring the effective protection of citizens' rights and safety in the field of labor protection. This research contributes to a deeper understanding of the legal aspects of both of these criminal norms and fosters further development in legal practice within this area.
