Abstract

The article analyzes the implementation of environmental reform in Ukraine. The bills were studied and analyzed: “On State Environmental Control” (№3091), “On Amendments to Certain Legislative Acts of Ukraine Concerning the Implementation of Provisions of Certain International Agreements and Directives of the European Union in the Field of Fauna and Flora Protection” (№2351); "On the prevention, reduction and control of pollution arising from industrial activities." (№4167); "On the territory of the Emerald Network". (№4461). The importance of comprehensive environmental reform in Ukraine, an important component of which is to bring national legislation in line with the EU-Ukraine Association Agreement, is emphasized. On July 15, 2021, 251 deputies of the Verkhovna Rada of Ukraine voted for an important institutional environmental reform, supporting in the first reading the bill №3091 "On State Environmental Control", which provides for a comprehensive regulation of legal relations between the state and all controlled entities on environmental protection legislation, introduction of modern mechanisms of control and responsibility, which will help increase the level of compliance with environmental legislation. The bill provides for a systematic reform of state environmental control. The Parliament of Ukraine also supported Bill 352351 “On Amendments to Certain Legislative Acts of Ukraine Concerning the Implementation of Provisions of Certain International Agreements and Directives of the European Union in the Field of Fauna and Flora Protection”, which implements European animal management standards in Ukraine. The document protects animals from abuse, exploitation, cruelty and death, aligning national legislation with a number of EU directives related to the European Convention for the Protection of Animals, which Ukraine ratified in 2013. Another important component of environmental reform is the fight against industrial pollution. The draft law №4167 "On prevention, reduction and control of pollution arising from industrial activities" is aimed at this. It aims to incorporate into national law the provisions of Directive 2010/75 / EU on industrial emissions. On July 15, 2021, the voting for the bill №4167 was disrupted for the third time. On the way to European integration, this is a big step backwards for Ukraine, as this bill is an important tool for protecting the human right to a safe environment for life and health. Unfortunately, the parliament did not support the bill №4461 "On the territory of the Emerald Network". The document is sent for revision. Thus, recent events show that Ukraine is making "one way forward and two way back" on the path of environmental reform. But everyone understands that only the implementation of comprehensive environmental reform in Ukraine will ensure the human right to a safe environment for life and health, the progress of our state on the basis of sustainable development and integration into the EU.
