ДО ПОНЯТТЯ ТA OЗНAК ГOСПOДAPСЬКИХ ПPAВOВIДНOСИН В СУЧАСНІЙ ПАРАДИГМІ ГОСПОДАРСЬКОГО ПРАВА

Abstract

At the beginning of the new millennium, our country is experiencing a turning point in its formation and development. Transformation processes cover almost all spheres of the national economy and state institutions. How successful they will be, how well and quickly the mechanism of legal regulation of their activities and relations between them will depend on Ukraine's future in a difficult geopolitical environment in the 21st century.
The scope of airspace, which is naturally considered to be a component of the sovereign territory of our state, is no exception. Today, this area is very promising, especially in the area of airspace business.
Therefore, it is important to understand that truly effective economic use of airspace is not possible without a clear legal regulation of economic relations in this area, and, above all, it concerns the precise definition of the legal status of economic operators in the field of use of airspace of Ukraine (PP of Ukraine), as well as the consolidation of the legal forms of these entities, the features of their powers, rights and responsibilities in the field of management. In this regard, the relevance of the topic of this work is undeniable.
It is worth noting that some aspects of the organizational and legal foundations of economic activity in the field of airspace use were investigated by such scientists as LA Zhuk, NM Korchak, AA Gelich, TG Udalov. In particular, the scope of their scientific work concerned the issues of economic activity in the use of Ukrainian airspace, the legal status of airlines in business relationships, increasing the competitiveness of Ukrainian airlines in the international market, as well as the problems of improving business activity in the use of airspace.
As for the definition of the concept and types of organizational and legal forms of economic entities in the use of Ukrainian airspace, it was not considered as a separate area of research in domestic legal science.
In addition, the original basis of the work is the original state regulatory acts, such as the Constitution - the basic law of Ukraine, the Economic, Civil and Air Codes of Ukraine, in the part related to research issues, as well as a number of laws, decrees, decrees and orders, and also the charters of some aviation companies that determine certain aspects of the legal regulation of the organizational forms of economic entities in the use of airspace.
The object of this work is public relations on the right regulation of the functioning of the subjects of economic use of the airspace of Ukraine.
The subject of the research is the nature and content of the organizational and legal forms of economic entities in the use of Ukrainian airspace.
