THE COURSE TOWARDS INNOVATIVE DEVELOPMENT AS THE MAIN IDEA OF MODERNISATION OF COMMERCIAL LEGISLATION OF UKRAINE AT THE STAGE OF ITS RECOVERY

In modern conditions, the economic development of society is due to innovation, the introduction of new technologies through competition, the achievement of competitive advantages. This follows from the theory of innovation development, the theory of innovation and the principle of competitiveness. Conceptually and strategically, economic and legal regulation should be reoriented from the accumulation of regulatory requirements, detailed regulation of economic activity to comprehensive encouragement of entrepreneurship and private initiative, and the use of scientific and technical potential. Economic legislation, along with other areas of law, should create the most favorable climate for innovation. This can be done by ensuring economic competition of products. Thus, encouraging competition for innovative development is an urgent issue. For its solution, legislative support of innovations by the state in the above areas, the relevant legal regulation should be based on innovative, anti-bureaucratic style of legal mediation of relevant relations. As for the principles of economic and legal regulation, this means that, above all, all the provisions of the CCU must "work" to solve the problem of innovative economic development by encouraging competition. There should be no declarative, stillborn provisions. We propose to enshrine in the CCU strategic goals, interests of the state and society in the development of the economic system (economy), stability, national security of Ukraine and determine the means, standards of conduct of economic entities that would achieve the goals in the most effective way. This will ensure a more purposeful action of these tools in achieving strategic goals, the implementation of program objectives. Increasing the effectiveness of these tools should be due to their focus on solving major problems, preparation and legal consolidation of the most effective means of solving these problems, interconnectedness, coherence of relevant tools, and thus achieve due to this so-called synergistic effect.
