Abstract

The article is devoted to the implementation of the constitutional principles of equality in the branch of labor law. In the course of researching the manifestations of discrimination on the basis of gender in labor relations, flaws in the legal regulation were revealed. The causes and consequences of gender inequality are analyzed. This inequality mostly manifests itself in several forms, including discrimination in employment, the difference in pay (gender gap) and unequal opportunities for promotion, career growth, access to the profession.

Such manifestations are a direct violation of the provisions of the Constitution of Ukraine and guarantees of legality, especially given the fact that at the legislative level, ensuring and guaranteeing gender equality are quite developed institutions of both international and national law.

The topic of gender equality and the observance of women's labor rights is becoming more relevant in the conditions of martial law, when the problem of the outflow of the able-bodied population from Ukraine to abroad is on the agenda, which, in combination with mobilization, causes a shortage of personnel in the labor market.

The consequences of manifestations of gender inequality can have both a local impact on corporate relations and cause negative phenomena at the national level. The democratic principle of equality is a direct indicator of the degree of compliance with the principles of the rule of law and legality. In addition, problems in the implementation of the principle of equality in labor relations have a significant impact on both corporate relations and the economy of the country as a whole.

The issue of gender equality requires many changes: systemic, legislative, and worldview. First of all, it is necessary to ensure the implementation of the principle of equal pay for equal work at the regulatory and organizational level. As a result of the research, ways to overcome the specified problems are proposed.
