EXAMINATION OF A CORPSE AT THE SCENE DURING MARTIAL LAW: FORENSIC ASPECTS

Abstract

The article is devoted to the analysis of data on the work of pre-trial investigation bodies during investigative actions in criminal proceedings, when collecting the evidence base during the examination of a corpse at the scene of the incident for further forensic medical examination during the legal regime of martial law. For an objective study of this issue, the normative and legal provisions of the national legislation were analyzed, which regulate the procedure for conducting procedural actions related to the collection and evaluation of materials for the appointment of a forensic medical examination. The cases from the practice of representatives of law enforcement agencies when inspecting the scene of an event and a corpse during the operation of the legal regime of martial law were investigated. А number of current problematic issues have been identified that arise when examining a corpse in a place nearing the time of war. The particularity of the inspection of the place under special circumstances (the place of mass execution of civilians and the place of mass burial of civilians, where corpses were discovered) after the discovery of military operations was noted. A number of gaps have been identified in the national legislation that regulate the development and improvement of the ship medical service of Ukraine, but do not regulate the nutritional activities and specialization of ship medical experts during the period of emergency duty. The investigation of the officials during the inspection of the place is underway, which will further highlight the accuracy and reliability of the materials that are the objects of the investigation of the ship medical examination.
