Abstract

The article is devoted to the research and analysis of the legal regulation of the activity of river ports and river infrastructure in general. This article also outlines the main problems of legal support for river infrastructure activities. According to the authors, these problems lead to the improvement of the legal and regulatory framework that will regulate river ports and river navigation.

The authors analyzed the national legislation and concluded that the river inland waterway infrastructure is currently declining due to a number of problems, which in turn leads to a weakening of this sector of the economy. The article states that the main direction of solving all obstacles is the adoption of the relevant legislation, namely the Law of Ukraine "On Inland Water Transport". Delaying the enactment of this regulatory act is one of the biggest problems in this area. The efficiency of river navigation and the proper use of river infrastructure depends to some extent on legislation. The article states that the only modern legal act that regulates legal relations in the sphere of river transportation is the Law of Ukraine "About Transport". But, according to the authors, the river mode of transport is very specific, and this gives grounds to argue that a more specific legislative act is  required for the legal regulation of this sphere. The solution to this problem is provided by the draft Law on Inland Water Transport, which will also regulate the status of river ports. The authors analyzed the bill, which was published for public comment. The article provides information on the steps taken by the Ministry of Infrastructure to develop a bill that is scheduled to be implemented further.
